Collin County District Attorney Greg Willis has addressed allegations from Mike Howard, the lead defense attorney in Karmelo Anthony's murder trial. Anthony is currently serving a 35-year sentence following his conviction for the murder of Austin Metcalf.
Howard's affidavit, part of Anthony's appeal, asserts that prosecutors violated a supposed agreement that limited character evidence regarding Anthony and the Metcalfs. He also argues that a key closed-door hearing was hastily conducted, which impeded the defense's ability to prepare.
Willis contends that transcripts from the court contradict many assertions made by Howard. He remarked that the claims do not align with the actual court proceedings. During a private discussion about Anthony's potential testimony, Howard admitted that the agreement was honored, while Judge John Roach Jr. made it clear that he would not uphold informal agreements in criminal cases.
Howard's affidavit indicates he believed Anthony would testify but suggests the judge restricted their preparation time. However, the transcript reveals that the judge thoroughly explained Anthony's rights and allowed more than 30 minutes for the defense to deliberate. Anthony ultimately chose not to testify after consulting with his parents.
Willis expressed his surprise and confusion over Howard's claims, defending the prosecution's actions as fair and professional. Howard did not respond to inquiries and will not take part in the upcoming appeal. Willis anticipates that Anthony's appeal will not succeed, expressing confidence in the conduct of his legal team. The first hearing regarding the appeal may take place as early as next month.
